Online Ordering Terms & Conditions

INTRODUCTION

By visiting, viewing or ordering from our website you agree to be bound by the Terms and Conditions outlined in this Agreement.

This Agreement outlines the trading Terms and Conditions that apply to all WinterMitchell Pty Ltd, trading as Hang Logic (ABN 86 167 645 927) transactions, including but not limited to online, phone and email ordering. It also outlines specific terms of use applicable to all aspects of our website.

The words we, us, our refer to WinterMitchell Pty Ltd, trading as Hang Logic. The words you and your refer to registered users, customers, resellers, associates, suppliers or general public visitors to our website.

We may amend this Agreement at any time at our discretion by posting the amended terms on our website. Any amendments to this document will be noted on the website. Except as stated below, all amended terms take effect immediately once they are posted. This Agreement may not be otherwise amended except through a written request from you (signed) and agreed by us (signed).

This Agreement is effective from 1 November 2013 (last updated 30/11/2025).

1. GOVERNING LAW

a. The Terms and Conditions of this Agreement are governed by the applicable statutory rules and regulations enforced by the Federal Government of Australia and the laws of the State of South Australia.


2. INTENDED USE

a. All material, including but not limited to text, images, multimedia, advertisements and downloadable content, is published by us and made available to worldwide audiences. If you access this website outside of Australia, you do so at your own risk and you must comply with the rules and regulations enforced by your respective jurisdiction.

b. You agree that differing terms and conditions may apply to local (Australian) and international customers.

c. The general public of all ages may view all publicly available material and may copy it for personal use only. You may only use material for commercial purposes where you have prior written consent from Hang Logic.

d. Registered users may include, but are not limited to, members of the general public, employees or representatives of companies, associations, governments or any other corporate entity.


3. DISCLAIMER AND LIMITATION OF LIABILITY

a. All material on our website is provided to you “as is” and “as available”. We do not warrant or guarantee the accuracy, adequacy or completeness of this material, and expressly disclaim liability for mistakes, misleading information or omissions.

b. It is the client’s responsibility to check and ensure that the product(s) reflect their requirements and specifications before placing an order. Once an order is placed with us, we will supply the product(s) as selected by the client.

c. To the maximum extent permissible by law and unless otherwise specified, we do not warrant, guarantee or make any representations and warranties of any kind, whether express, implied or statutory.

d. Whilst we actively work to combat malicious activities, we do not warrant, guarantee or make any representations that our website will be free from such behaviour, including but not limited to viruses, hacking or denial of service attacks. We also do not warrant, guarantee or make any representations that our website will be fully accessible at all times, and disclaim any loss or damages as a result of it being unavailable.

e. To the maximum extent permitted by law, we disclaim liability for any damages, including, without limitation, direct or indirect, special, incidental, compensatory, exemplary or consequential damages, losses or expenses, including without limitation lost or misdirected orders, lost profits, lost registrations, lost goodwill, or lost or stolen programs or other data, however caused and under any theory of liability, arising out of or in connection with
(1) use of this site, or the inability to use this site by any party, or
(2) any failure of performance, error, omission, interruption, defect, delay in operation or transmission, or
(3) line or system failure or the introduction of a computer virus, or other technical sabotage, even if we or our employees or representatives are advised of the possibility or likelihood of such damages, losses or expenses.


4. METHODS OF ORDERING

a. Internet

Ordering over the internet enables customers to access real time pricing and information for our entire product range. It also allows you to view order history and access other features to save time and effort.

i. All online orders are treated as an express intention to purchase the nominated goods (Purchase Order) for the agreed online prices.
ii. You accept that, other than Freight on Board (FOB), all other freight charges for special or oversize products may not be included with your online Purchase Order and that further charges may apply. See 8. DELIVERY below.
iii. We reserve the right to alter the agreed price if an incorrect price was caused by a software fault, error or malicious attack.

b. By phone or email

iii. All phone and email orders are treated as an express intention to purchase the nominated goods (Purchase Order) for a previously quoted price.

c. In person (warehouse/showroom)

i. You may visit our warehouse/showroom to discuss your requirements, select products and place an order in person.
ii. Where stock is available and payment has been completed, you can take the goods with you immediately.
iii. In-person orders are subject to the same pricing, freight and returns conditions as online and phone/email orders.


5. PRICING

a. Unless otherwise specified, all prices on our website are quoted in Australian Dollars (AUD).
b. Listed prices are displayed including GST.


6. ORDER PROCESS

a. Unless previously quoted, you accept that any extra freight charges will be added to your order. If you have not provided Authority to Leave (ATL) or a safe place for delivery and the courier records the delivery as “no one in attendance” or similar, any depot and redelivery fees charged by the courier will be on-charged to you by Hang Logic and invoiced after successful delivery. We rely on the courier’s tracking and scan records as evidence of delivery attempts, and we are happy to provide these details if you wish to follow up with the courier directly.

b. Once payment has been received, your order will be processed within two business days (Monday to Friday, excluding public holidays) and dispatched unless otherwise advised.


7. METHODS OF PAYMENT

For ordering online we accept the following methods of payment:

a. PayPal using your PayPal ID and Secure Socket Layer (SSL) technology. If you do not have a PayPal ID, you can pay by credit card (Visa and Mastercard).

b. Secure credit card transactions with a payment gateway using Secure Socket Layer (SSL) technology (Visa and Mastercard).

c. Direct bank transfer from your Australian bank account to our Australian bank account. Your order will be put on hold until the funds transfer is complete.

d. A payment is considered complete when the funds have been cleared.

e. Cash payments in person at our warehouse/showroom. You can pay in cash when collecting from our warehouse and showroom. Your order is confirmed once full payment has been received and a receipt will be issued at the time of payment.

f. Payments for in-person orders (no card facilities onsite).
We do not have EFTPOS or credit card facilities at our warehouse/showroom. For in-person orders, payment can be made by cash or by initiating a bank transfer using your online banking on your phone or device while you are with us. Goods will only be released once payment has been received or verified by us.


8. DELIVERY

We work with specialist freight providers who access multiple courier services to obtain competitive delivery prices and reliable service.

a. Packaging
All orders are securely packaged so products should arrive as they left: in perfect condition.

b. Delivery options and charges (domestic)
During the checkout process you will be presented with delivery options and prices for your goods.

c. Oversize items and specialised freight
Larger items that exceed the maximum weight or size limits for Australia Post or standard couriers will show the option for local pickup at our warehouse or delivery through specialised freight carriers.

i. Request a quote to deliver the goods to your location (we ship Australia wide).
ii. Arrange an appointment for you or your agent to pick up the goods from our warehouse.
iii. Arrange an appointment to pick up in person from our showroom/warehouse.

d. International deliveries
Orders sent internationally will be delivered through freight forwarders. Extra costs apply for longer items. Purchasers are responsible for all customs duties and taxes in the country of destination. Delivery costs for international orders are provided on request.

e. Documentation
An itemised tax invoice containing a description of goods purchased and freight charged accompanies all orders.

f. Delivery addresses
We deliver Australia wide, including PO Boxes, parcel lockers and building sites where a contact person is available. (And no, we do not deliver to the moon or Mars – not until ArtiTeq brings out the Zero Gravity Rail.)

g. Tracking and courier contact
Once your order has left our warehouse and been handed to the courier, it is in the care of the freight provider.

If your order is delayed, missing, or marked as delivered when you have not received it, we ask that you contact the courier directly in the first instance, using the tracking or consignment number provided in your shipping confirmation.

Delivery times can be affected by factors outside our control, such as traffic, road accidents, weather events, peak periods and depot backlogs. We will always provide you with tracking details and, where needed, support you with information for any investigation, but we are not responsible for delivery delays or errors caused by the courier or external factors.

h. Damaged in transit or incorrect items
If your order arrives damaged, or you receive the wrong items, please notify us as soon as possible and within 5 business days of delivery.

Please email team@hanglogic.com.au with:
i. your order number,
ii. a description of the issue, and
iii. clear photos of the outer packaging, the shipping label, the inner packaging and the damaged or incorrect items.

Please keep all packaging and items until we let you know the next step, as the courier may require inspection or collection.

We photograph the contents of orders as part of our packing process, and may refer to these internal photos when assessing your claim. Where goods have been damaged in transit, or we have sent incorrect items, we will arrange a replacement or other remedy in line with the Australian Consumer Law, and we will cover reasonable freight costs for any approved return or reshipment.


9. RETURNS & WARRANTY

a. Australian Consumer Law
All our products are covered by the Australian Consumer Law (ACL). This means you are entitled to a replacement or refund if a product has a major fault, and you can ask for a repair or replacement if it is not of acceptable quality. You may also be entitled to compensation for any other reasonably foreseeable loss or damage.

b. Manufacturer’s warranty
On top of these legal rights, Hang Logic offers a 10-year manufacturer’s warranty on all ArtiTeq rails, giving you extra peace of mind. This warranty applies to defects in materials and workmanship under normal use and installation, and is in addition to your rights under the ACL.

c. Exclusions from warranty
The manufacturer’s warranty does not cover damage or faults caused by incorrect installation, use of non-compatible components, overloading rails or hooks beyond their rated capacity, modification of products, misuse, abuse or normal wear and tear.

Rails and hanging hardware must be installed and used in accordance with the supplied instructions and weight ratings. If products have been installed or used contrary to these instructions, any resulting damage will not be covered by the warranty.
